I am writing to you to express my disappointement and my anger. I was pleased to discover with Kiss a hardware manufacturer that was using GPL software, advertising this use and publishing the source code you were redistributing, in accordance to the GPL terms. However, the interview you gave to the Danish National Radio about a possible GPL violation (strongly supported by the comparison of your binaries with those of the Mplayer project) is an insult to the Open Source community and I cannot recommend the Kiss players anymore.
In this interview, you pretend the GPL is weak because it has not been tested in court, and thus not compatible with businesses. Then why do you use GPL code in your players ? By using it, you have understood and accepted the terms of this licence. Moreover, you strongly take advantage of it, since the Linux kernel is the base system of your players.
This stand is very hypocritical. If you consider that the GPL is barely valid, you should not use a such "risky" licence, and not advertise the usage of Open Source Software in your devices. Moreover, if the GPL were not valid in your country, the GPL code would not be public domain, and would be usable only under the copyright law. Thus, by not supporting the GPL, you also reject the system that makes your players work ! This way, you insult the Open Source community, which you claim you support.
As a potential customer, you can be assured I will never buy your player until full compliance to GPL software. Moreover, I will report this issue to various media as much as possible. Also, the money I wanted to spend to buy a player will advantageously go to the Free Software Fundation, so that the rights of the GPL will be defended in court, if necessary.
